Notice to the Profession
Corporations List
On 24 October 2022 the Court notified practitioners of the allocation and listing procedures for corporations matters (see Schedule 1 to the Commercial and Corporations Practice Note (C&C-1)).
This notice explains the allocation and listing procedures which apply to corporations matters filed in the New South Wales, Victorian, Queensland and West Australian registries where weekly Corporations Lists have been established and will continue to operate (see Schedule 1 to the Commercial and Corporations Practice Note (C&C-1)).
The weekly Corporations List in the South Australian registry has ceased to operate because there are insufficient filings at present to justify running a separate list. Corporations matters filed in the South Australian registry will be immediately allocated to a docket judge for case management and hearing.
1. New South Wales and Western Australia
The Corporations List in New South Wales and Western Australia is conducted at 9.30 am (local time) on Thursday of each week.
Corporations matters filed in the New South Wales and West Australian registries will be returned in the weekly Corporations List as follows:
(a) applications filed on or before 12 noon on a Wednesday in any week will be returned in the Corporations List for the Thursday of the next week; and
(b) applications filed after 12 noon on a Wednesday in any week will be returned in the Corporations List for the Thursday of the week after the next week.
2. Queensland and Victoria
The Corporations List in Queensland and Victoria is conducted at 9.30 am (local time) on Friday of each week.
Corporations matters filed in the Queensland and Victorian registries will be returned in the weekly Corporations List as follows:
(a) applications filed on or before 12 noon on a Thursday in any week will be returned in the Corporations List for the Friday of the next week; and
(b) applications filed after 12 noon on a Thursday in any week will be returned in the Corporations List for the Friday of the week after the next week.
3. General
The Corporations List will be conducted in these registries on the basis that short matters (with an estimate for hearing of up to two hours) will usually be heard and determined when first returned or shortly thereafter, longer matters will be programmed for hearing and allocated to a docket judge for hearing on a date to be fixed by that judge. Where appropriate, matters may be referred to a registrar.
If the matter is immediately allocated to a docket judge, rather than made returnable in the Corporations List, then the parties will be notified of the date for a first case management hearing by the docket judge.
More urgent matters may be referred to the Commercial and Corporations Duty Judge.
Note: For urgent corporations matters parties should continue to approach the Commercial and Corporations Duty Judge in their registry (see Part 4 of the Commercial and Corporations Practice Note (C&C-1)).
